2025 Amendments to the Act for the Recruitment and Employment of Foreign Professionals
Key Highlights for International Students and Foreign Professionals
Most provisions will take effect on January 1, 2026, while Articles 28, 29 and part of Article 4 will take effect on June 30, 2026.
To enhance Taiwan’s global talent environment, the amendments introduce the following key changes:
1. More Flexible Pathways for International Graduates in Taiwan
The amendment will allow overseas Chinese or foreign students who graduate with an associate degree or above from Taiwan to stay for 2 years after graduation and apply for jobs without a work permit. They may also attend occupational training, internships, work part-time, or engage in entrepreneurship to facilitate their future development in Taiwan.
2. Easier Access to Work for Graduates from Top Global Universities
Graduates from the world’s top 200 universities may directly apply for individual work permits to engage in professional work.
In addition, the exemption from the two-year work experience requirement has been expanded to graduates from the top 1,500 universities worldwide, further encouraging young talent, especially from New Southbound Countries, to work in Taiwan.
3. Expanded Work Rights for Spouses of Foreign Professionals
The amendments ease restrictions for spouses of foreign specialist/senior professionals to apply for work permits through Ministry of Labor and work freely in Taiwan, enhancing family stability and overall attractiveness for long-term residence.
4. Faster and More Accessible Permanent Residence
Foreign specialist professionals may apply for permanent residence after just one year of residence, significantly improving Taiwan’s competitiveness in attracting top global talent.
5. Improved Employment and Retirement Security
Foreign professionals, including those without permanent residence, may now participate in the new pension system, allowing pension accumulation across job changes.
Employment insurance coverage has also been expanded to provide stronger protection throughout their careers and into retirement.
6. Access to Disability and Long-Term Care Services
Foreign professionals with permanent residence who have lived in Taiwan for 10 years or more may apply for disability care and long-term care services, including home care and day care, ensuring long-term quality of life comparable to that of Taiwanese citizens.
